Like all of us, I don’t know what happened on that night in Dover. But there are a few things that I do know, or have an opinion about, and would love to debate the issue.
First thing, I do understand that NASCAR and Stewart-Haas Racing are keeping a close eye on the progression of Kurt’s case, but there is a part of me that feel that something more could be done. Innocent until proven guilty, I know. If Patricia Driscoll had called the police the night of the incident, one can hypothize that Kurt Busch would have been arrested. Would NASCAR have suspended him then? What about Stewart-Haas? Shouldn’t the sport as a whole take a good hard look at the response of the fans to how the NFL handled their domestic violence issues and take a cue?
Secondly, Busch’s defense attorney is mediocre at best. Driscoll accuses Busch of grabbing her by the throat and slamming her head against the wall multiple times. The first defense going out of the gate is that nothing would have happened that night had Driscoll not shown up unannounced. Really? That is how you want to respond to an allegation to Domestic Violence? Not only does it make your client sound guilty, but it gives off the impression that Kurt Busch, Stewart-Haas Racing, and NASCAR in general want to partically blame the victim of Domestic Violence. Rusty Hardin needs to recognize that by defending a Professional NASCAR Driver, he is not just representing the person, he is representing a man with a known temper that has cost him jobs in the past, a man that has shown that he feels above the law (remember the DUI incident in Pheonix?), is derespectful to media, and all in all has an anger managment issue, AND Stewart-Haas Racing, as well as NASCAR. So coming out with a statement such as that comes off ignorant, insensitive, and dismissive of the alleged incident.
Furthermore, you allege that Driscoll is a trained killer that stated, “I take down foreign governments. I own Washington.” You put Busch on the stand where he alleges that she left in the middle of the night in Camoflage and came back in a trenchcoat and an evening gown covered in blood. Seriously? So now not only have you given the impression that your client is guilty, but his also crazy. What is the reason for such testimony? Is Busch trying to state that he is innocent because he was scared of his trained killer girlfriend? If that REALLY happened, and you were in his shoes, and someone close to you told you such things, and did such things, wouldn’t you really looking hard at that person, and their touch with reality before you would believe it? Okay, so your girlfriend leaves in the middle of the night in camos, comes back and is in a bloody evening gown covered by a trenchcoat, and your first thought wasn’t to call the police? I mean, if she is a Governmental Trained Killer, it’s not like she is going to get into trouble right?
If I were Kurt Busch, and worried about my damaged reputation, I would rather go out publically and say I ended my relationship with Driscoll because she appeared unstable, and crazy, rather than be accused of Domestic Violence.
If I was Kurt Busch’s attorney, and I even wanted to go there (which I probably wouldn’t) I would stated that Driscoll made such statements, and that Busch ended the relationship because of it. Make her appear to have mental issues. Not make the whole situation appear laughable.
Better yet, if I was his attorney, I would tell him to request his own protective order, and request the court stop wasting everyone’s time and taxpayer’s money and grant them both protection orders. I can’t imagine that either has anything to say to the other.
